1. Acceptance of Terms
By accessing or using the SmartAiRe - a Product of NASHDOM INNOVATIONS LLP websites, products, and services (the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Services.
2. Eligibility and Account
You must be legally capable of entering a binding contract. You are responsible for maintaining the confidentiality of your credentials and all activities under your account. Notify us immediately of any unauthorized use.
3. License and Acceptable Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. You agree not to: (a) copy, modify, or create derivative works; (b) reverse engineer or decompile; (c) bypass security or rate-limit controls; (d) use the Services to transmit malicious code or infringing, unlawful, or harmful content; or (e) interfere with or disrupt the integrity or performance of the Services.
4. Subscriptions, Billing, and Taxes
Some features require a paid subscription. Prices, features, and limits are described on our pricing page and may change from time to time with notice where required by law. Subscriptions renew automatically unless canceled in accordance with your plan terms. You authorize our payment processor to charge your payment method for applicable fees, taxes, and adjustments. Trial periods, if any, are subject to the terms presented at sign-up.
5. Content and IP
SmartAiRe - a Product of NASHDOM INNOVATIONS LLP and its licensors own all rights, title, and interest in and to the Services, including content, software, trademarks, and associated intellectual property. You retain rights to content you upload to the Services ("Your Content"). You grant SmartAiRe - a Product of NASHDOM INNOVATIONS LLP a limited license to host, process, display, and transmit Your Content as necessary to provide the Services. You represent you have all rights necessary for Your Content and that it does not violate law or third-party rights.
6. Confidentiality
Each party may have access to the other’s confidential information. The receiving party will protect the disclosing party’s confidential information with reasonable care and use it only for purposes of these Terms.
7. Third-Party Services
The Services may interoperate with or link to third-party applications or services. Your use of those services is subject to their terms and privacy notices. We are not responsible for third-party services.
8. Warranties and Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted, secure, or error-free operation.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER SMARTAIRE - A PRODUCT OF NASHDOM INNOVATIONS LLP NOR ITS AFFILIATES OR SUPPLIERS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO SMARTAIRE - A PRODUCT OF NASHDOM INNOVATIONS LLP FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
10. Indemnification
You will defend, indemnify, and hold harmless SmartAiRe - a Product of NASHDOM INNOVATIONS LLP, its affiliates, and personnel from and against claims, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content or your use of the Services in violation of these Terms or applicable law.
11. Compliance and Export
You agree to comply with all applicable laws, including privacy, anti-spam, anti-corruption, sanctions, and export control laws. You represent you are not located in a jurisdiction where use of the Services is prohibited by law.
12. Governing Law and Disputes
These Terms are governed by the laws applicable to your contracting entity’s domicile, without regard to conflicts of law principles. Mandatory consumer protections under local law remain unaffected. Any dispute will be resolved in the competent courts of that domicile, unless otherwise required by law.
13. Changes to Terms
We may update these Terms from time to time. We will post the updated version and update the "Last updated" date above. Material changes may be communicated by email or in‑app notice.
